Acceptance of Terms

This Terms of Use Agreement ("Agreement") between Simurg LLC (“New Zeppelin”) ("we," "us," or "New Zeppelin") and you governs your access and use of our project management platform available at www.newzeppelin.com (the "Site") and the monthly plan or other services we offer (the "Services"). By using this Site and accessing our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

You acknowledge and agree to New Zeppelin's Privacy Policy by accessing and using the Site and the Services. Additionally, the applicable terms and conditions may be posted and updated from time to time.

  1. Changes to the Terms: We may modify these Terms at any time. Such changes will be effective immediately upon posting on the New Zeppelin Terms of Use Page. Your continued use of the New Zeppelin and Services after such posting constitutes acceptance of the changes.
     
  2. Changes to Websites: We may change or discontinue any aspect, service, or feature of the Site at any time, including content, availability, and equipment required for access or use.
     
  3. Registration: You may register via an online form or by participating in Interactive Areas, creating a user account ("Your Account"). By registering, you represent and warrant that all information provided is current, complete, and accurate. You agree to maintain and update your registration information promptly. You are responsible for obtaining and maintaining all connectivity, computer software, hardware, and other equipment needed for access to and use of the Site and all associated charges.
     
  4. Use of the Services: The start date of your trial and monthly plan begins on the date of your Kick-off Meeting with your assigned Creative Project Manager. Subject to compliance with this Agreement and timely payment, we will provide the Services for the term of your purchase. You may use the Services for any projects and scopes purchased under the applicable monthly plan. Delivery timelines depend on various factors, including the plan purchased and project complexity.     You own all information, data, or materials provided to us to use the Services ("Customer Content"). By submitting Customer Content, you represent that you have the necessary rights to distribute it. You grant us a worldwide, royalty-free, non-exclusive license to use Customer Content to provide the Services.
    You are the sole owner of all rights, title, and interest in the deliverables, including intellectual property rights. Any deliverables qualifying as “work made for hire” are deemed as such for you. For deliverables not constituting a “work made for hire,” we assign you all rights, title, and interest. This is subject to compliance with this Agreement and full payment.
    We retain ownership of any pre-existing materials used in providing the Services and grant you a limited license to use them as incorporated in the deliverables. All client interactions are recorded for quality assurance, with confidentiality protected.
     
  5. Pausing Your Subscription: You may pause your subscription by notifying us in advance. Your plan will remain active until the end of the current billing month, and you will not be charged for subsequent months during the pause. Your subscription and account settings will be maintained during the pause. Notify us when you are ready to resume, and your subscription will be reinstated immediately.
     
  6. Cancelling Your Subscription: If you cancel at the end of the trial period, your payment will be refunded. If you continue after the trial, the 2-week trial counts towards your first month. Cancelling after the trial results in the loss of rights to use delivered work. New projects cannot be requested under a canceled plan. Files created during the subscription will be deleted 60 days after it ends unless you opt to store them for $29 per month. To cancel, submit your request through the Control Panel with 7 days' notice before renewal.
     
  7. Modifying Your Monthly Plan: Modify your subscription through your creative project manager, with changes reflected the following month.
     
  8. The Provided Service: You can submit unlimited project requests, which will be managed according to your subscription plan. Video call limits and access to stock images vary by plan. For detailed information, visit the Pricing page.
     
  9. Turnaround Time: We aim to respond to requests within 24-48 business hours. Turnaround times may vary for complex projects, managed by the creative project manager.
     
  10. Ownership and Copyright: All designs and source files created for you are your property. In case of subscription cancellation, files will be delivered to you, and you are responsible for their storage. We respond to copyright infringement notices under applicable law.
     
  11. The Associated Monthly Fee: Monthly plans have no long-term commitment and can be paid by credit/debit card. Failure to pay on time results in suspension and penalties. Plans can be extended daily for a fee. Each company is allowed only one trial per 12 months. Visit the Packages & rules page for fees and penalties.
     
  12. Business Hours: We do not operate on weekends and certain holidays. Please communicate with your Creative Project Manager or check out the calendar.
     
  13. Confidential Information: Both parties agree to hold each other’s Confidential Information in confidence and not disclose it to third parties, except as permitted.
     
  14. Term and Termination: This Agreement terminates upon the expiration or termination of your account or monthly plan. Certain sections will survive termination, including confidentiality obligations and limitations of liability.
     
  15. Disclaimer of Warranties: The New Zeppelin and Services are provided “as is, as available.” We disclaim all warranties to the extent permitted by law.
